Terms and Conditions

  1. Instructions on how to enter the Competition and details regarding the Competition contained herein form part of these Terms and Conditions. Entry into and participation in this Competition is deemed acceptance of these Terms and Conditions. This Competition is not valid in conjunction with any other offer, competition or promotion by RØDE.
  2. The Competition is free to enter and open to any person, subject to paragraph 3 below, except employees of RØDE, their immediate families and residents of any jurisdiction where it is prohibited.
  3. You must over 18 at the time of entry submission to enter. This will be verified by entering the date of birth field on the entry form.
  4. The Competition commences at 12.00 midday AEDT on 1 December 2017 (“the Commencement Date”) and closes at 12.00 midday AEST on 15 January 2017 (the “Closing Date”). The period between the Commencement Date and the Closing Date shall be the Competition entry period (the “Competition Entry Period”).
  5. To participate in the Competition, Entrants must write or provide a Script , Treatment or visual storyboard for a 3-minute film – of at least 1 page and no more than 4 pages.
  6. The script, treatment or visual storyboard, which be henceforth, known as the “Entry” must be the original work of the Entrant, the Entry must not have been entered or made previously in any other competition including previous “My RØDE Reel” competitions.
  7. The Entrant must own the whole of the copyright of the Entry. The Entry cannot contain any words, concepts, images or other material from any existing work which would be the copyright of a third party.
  8. The Entry must not defame any person or entity, or be disparaging to any religion, race, or nation, or contain language that is lewd, obscene or inappropriate, or use any copyrights, images, marks, trademarks or logos that the Entrant has not obtained permission for their use. RØDE reserves the right to disqualify any Entrant who does not comply with the conditions set out in this clause.
  9. The Entry must be submitted in Word or PDF format and in the English language.
  10. The winning Entry will be made into a film in the English language by RØDE, and the Entrant consents to their Entry being made into a film (the “Film”) and a behind-the-scenes featurette (“BTS Feature”) of the Film. The Entrant shall be given a credit as the scriptwriter/treatment/storyboard artist in the film credits of the film. RØDE shall retain all rights in the Film and the BTS Feature other than the copyright set out in paragraph 7.
  11. The Entrant shall be the one individual most responsible for the creation of the Entry.
  12. To enter the Competition, after the Commencement Date and prior to the Closing Date, the Entrant must submit their Entry via the website www.myrodereel.com (the “Website”) as follows:
    1. The Entrant must access the Competition Entry Page on the Website, and complete the Competition Entry Form by entering the details required therein in full, including but not limited to the full name, gender, date of birth, and address of the Entrant, any other contact details of the Entrant required and any other information requested therein; and
    2. The Entrant shall follow the instructions on the website to upload their Entry
  13. Once the Entrant has completed the submission of their Entry in accordance with paragraph 12, the Entrant shall then receive an email confirming receipt of their Entry by RØDE, and stating that the acceptance of their entry by RØDE is subject to moderation of their entry by RØDE in its sole discretion;
  14. Entrants must complete all of the steps itemized in paragraph 12, to the satisfaction of RØDE in its sole discretion, within the Competition Entry Period. RØDE will not accept any entries made outside the Entry Period or by any means other than that prescribed in paragraph 9.
  15. By entering the Competition, Entrants acknowledge, agree and declare that they are aware that their participation is entirely at their own risk and that they hereby waive, surrender and relinquish in favour of RØDE all claims of any nature and howsoever arising (including as a result of negligence) which but for this waiver, surrender and relinquishment they may or otherwise have against RØDE either directly or indirectly arising out of their participation in the Competition.
  16. By entering the Competition, the Entrant hereby warrants that all information submitted is true, current and complete. Any Entrants who have supplied incomplete, inaccurate or fraudulent information may be automatically disqualified. RØDE reserves the right to disqualify any Entrant if RØDE, in its sole discretion, has reasonable grounds to believe that an Entrant has breached any of these terms and conditions or has tampered with the Competition process. Failure by RØDE to enforce any of its rights at any stage of the Competition does not constitute a waiver of those rights.
  17. Incomplete, indecipherable or illegible entries will be deemed invalid. Entrants bear all responsibility to ensure that their entry is complete and legible, and is submitted in the correct format.
  18. Entrants are entitled to submit an unlimited number or entries, provided that each entry must comply with the entry provisions set out in paragraph 12.
  19. The costs of entering the Competition shall be borne solely by the Entrants.
  20. Each Entrant warrants that he or she has no other agreements or arrangements with any third parties relating to the Entry, service, image, name or likeness and/or other rights that may interfere with his or her entry into the Competition and the execution of his or her obligations as the winner in this Competition.
  21. The winner shall grant to RØDE a nonexclusive, irrevocable license to RØDE to publish their Entry and the Film in full on the RØDE website and social media channels, in the territory of the world, and in full or in part in any other promotional material of RØDE, for the purposes of the Competition.
  22. Following the Closing Date, the entries to the Competition shall be judged by a panel selected by RØDE in its sole discretion (the “Panel”).
  23. The winner of the Competition will be determined by the panel and the winner will be selected on the criteria of originality, creativity, practicality and quality as follows:
    1. The Panel shall determine a shortlist of 5 the best Entries;
    2. The Entrants whose Entry has made it into the shortlist will be contacted to confirm that they have made the shortlist, and if they are the winner of the Competition they are able to travel to Sydney on the designated dates in February 2018 for a pre-production meeting with the RØDE team who will be making the Film, and during the production of the Film and the BTS feature. Any shortlisted Entrants who are not able to travel on the designated dates in Sydney shall have their Entry removed from the shortlist and replaced by the next best entry as determined by RØDE in its sole discretion;
    3. The Panel shall consider the Entries on the shortlist to determine the winner of the Competition on the subjective personal opinions of the members of the Panel, whose decision shall be final;
    4. The Panel shall determine the winner of the Competition in the Panel’s sole discretion by midday AEST on 31 January 2018;
    5. Within twenty-four (24) hours thereafter, RØDE shall contact the winner via email to inform them of the Panel’s decision and shall announce the winner on the www.myrodereel.com website, and on RØDE’s Facebook, Twitter and Instagram accounts.
  24. The Winner will win the Prize Pack containing the following:
    1. Return economy flights from their closest major airport to Sydney International Airport;
    2. Transfers to and from the airport;
    3. Accommodation for three (3) nights in Sydney in a double room at a hotel of at least four stars at RØDE’s discretion;
    4. Reasonable costs of meals and refreshments of the Entrant;
    5. Work with the RØDE Video and Production Team to assist in creating the Film; and
    6. Work with the RØDE Video and Production team to create the BTS content during the filming of the Film.
  25. The Winner of the Prize Pack must be available to travel during the month of February 2018. If the Winner becomes unable to travel in February 2018 for whatever reason, then that Entrant shall thereafter be disqualified and the second placed Entrant will be declared the winner.
  26. All travel requirements, including but not limited to the appropriate visa and passport are the sole responsibility of the Winner.
  27. RØDE reserves the right to alter the content of any Prize Pack noted in paragraph 23 above in whole or in part at any time, whether by adding or removing Prizes. Any changes of the Prize Pack shall be notified by RØDE from time to time as the case may be.
  28. The Prize Pack on offer in the Competition, in full or in part, are non-transferable, non-negotiable, non-refundable, are not redeemable for cash, is subject to availability.
  29. RØDE reserves full and final creative control of the Film and BTS Feature at all times.
  30. The Winner agrees to abide by all safety instructions and directions as instructed by the RØDE Video and Production team whilst on the set of the Film.
  31. The winner agrees to participate in reasonable post-competition publicity for RØDE at RØDE’s expense, including but not limited to their attendance for interviews, photographs, videos and any other promotional activity specified by RØDE, and shall grant to RØDE a nonexclusive, irrevocable license to use their name, biographical details, photographs, videos, likenesses and any other information regarding the winner deemed appropriate for use by RØDE for any promotional and marketing purposes by RØDE for a period of one (1) year from the Closing Date.
  32. The terms and conditions of a related third-party supplier or suppliers of prizes may apply and shall be accepted by the Winner.
  33. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of RØDE, RØDE reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Entrant; or (b) to modify, suspend, terminate or cancel the Competition, as appropriate.
  34. RØDE hereby reserves the right to change, suspend or cancel the Competition, or to change these terms and conditions, by notice on the RØDE website. RØDE shall not be required to specify any reasons for the changes and shall not incur any liability as a result.
  35. Any cost associated with accessing the Competition website is the Entrant's responsibility and is dependent on the Internet service provider used. RØDE makes no guarantee of the availability of its web services and will not be held responsible for interruption of service that may interfere with the ability to participate in the Competition.
  36. Except for any liability that cannot be excluded by law, RØDE (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of this Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under RØDE's control); (b) any theft, unauthorised access or third party interference; (c) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by RØDE) due to any reason beyond the reasonable control of RØDE; (d) any variation in the type and specifications of the prizes to that stated in these Terms and Conditions; (e) any prize that has not been received by the claimant after dispatch by RØDE; (f) any prize that has been damaged in transit; (g) any tax liability incurred by an Entrant; or (h) use of the prizes.
  37. RØDE collects personal information of the Entrants in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, Competition suppliers and as required by law, to Australian or other regulatory authorities. Entry to the Competition is conditional on providing this personal information, and the Entrant must consent to the use of their personal information for the purposes of the Competition. RØDE may, for an indefinite period, and provided that the Entrant has provided their consent, use the information for promotional, marketing, publicity, research and/or profiling purposes, including sending electronic messages or telephoning the claimant. The Entrant may opt out of any promotional, marketing, publicity, research and/or profiling conducted by RØDE using their personal information at any time by giving RØDE notice of their intention to opt out. RØDE shall maintain all personal information in accordance with its Privacy Policy. Entrants should direct any request to access, update or correct information to RØDE.
  38. These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia. Entrants agree to submit to the non-exclusive jurisdiction of the courts of the State of New South Wales, Australia. RØDE shall comply with any laws applicable in the location where the Competition is held.
